Job Purpose
- To provide leadership in legal advisory services to the Authority and provide Board Secretariat services thereby creating a conducive legal environment for execution of the Authority’s mandate as stipulated in the Kenya Roads Act, 2007.
Job Description
Duties and responsibilities at this level will entail:
- Advising the agency and management on the legislation that affect KeNHA and changes made thereof;
- Providing legal guidance on contractual and statutory obligations binding to the agency;
- Providing and interpreting legal information, conducting training and disseminate appropriate legal requirements to staff;
- Coordinating the development, implementation and review of legal policies and procedures to ensure that they are in accord with the existing legislation;
- Safeguarding the agency’s interests and ensuring that they are adequately defended before the courts;
- Managing, reviewing and monitoring progress of all outstanding litigations;
- Issuing instructions, liaising with the agency’s appointed advocates with a view to ensuring they act in the agency’s interest while handling cases on its behalf;
- Ensuring the agency complies with constitutional, regulatory and all relevant laws through provision of legal advisory services;
- Documenting and maintaining a record of all enforcement and compliance assignments undertaken by the agency’s personnel and develop legal accountability structures in relation to enforcement assignments;
- Ensuring timely compliance with rules and regulations affecting the Agency, including the Code of Conduct and Ethics;
- Reviewing and updating of all the agency’s codes, regulations, rules, guidelines and laws for consistency and compliance with the national and county legal frameworks;
- Developing the agency’s proactive and preventive legal policies and strategies aimed at forestalling disputes, controversies and litigation;
- Providing secretariat to the senior management meeting and ensuring management decisions are converted to board papers where applicable;
- Developing and vetting policy papers and instruments with legal implications for approval by the agency;
- Coordinating legal compliance and governance audits; and
- Initiating the development of the agency charter and calendar as well as monitoring implementation.
Job Specifications
For appointment to this grade, an officer must have:
- Cumulative service period of fifteen (15) years relevant work experience, three (3) years of which must have been at the grade of Assistant Director, Legal Services or in a comparable position;
- Bachelor of Laws degree (LLB) from a recognized institution;
- Master of Laws degree (LLM) from a recognized institution;
- Post graduate diploma in Law from the Kenya School of Law;
- Admitted as an advocate of the High Court of Kenya with a valid Practicing Certificate;
- Membership to the Law Society of Kenya (LSK) and in good standing;
- Membership to the institute of Certified Secretaries of Kenya and in good standing;
- Certificate in Leadership Course lasting not less than four(4) weeks from a recognized institution;
- Proficiency in computer applications; and
- Demonstrated a high degree of professional competence, Managerial and administrative capability as reflected in work performance and results.
